they felt as if they were tied quite securely, even after he
tried to loosen them initially. His hands were still crossed
behind him, palms facing outward. Seeing no activity in the
area except for the lights of the several cars that passed,
ie shoved the front passenger side seat forward, turned around
and opened the unlocked passenger side door. Ue stepped out
of the car on the curb side of the street, but could not recall
which side of. the street the car was parked on-or in which
direction the car was facing. When he emerged from the car
he noticed a Volkswagen two-door bus parked approximately 20
‘feet from his car. He could not tell whether the taillights
were on or whether they just appeared to be on from reflected
light. He watched the bus for a short time and did not see
any moving silhouettes of any kind in the headlights of passing
cars. le walked down the street away from his car and the
Volkswagen bus and almost immediately came upon street signs
which indicated he was then at the corner of Garber and Tangle-
wood Streets. ;
BENENSON, realizing exactly where he was, proceeded
to the next corner which was Tanglewood Street and Claremont
Avenue. He proceeded west on Claremont Avenue down the hill.
He stopped briefly outside a diner called "The Station" which
was located at the intersection of Claremont Avenue and Russell .
Strect. He pointed out a dumpster type trash receptacle where
he attempted to find a sharp edge with which to cut his bonds.
Ne was unsuccessful in this endeavor and continued walking west
down Claremont Avenue. He walked with his hands still tied
behind his back similar to a walking posture assumed by many
Europeans. While proceeding down Claremont Avenue, approximately
half way between College and Ashby Avenues, he was able to work
his hands loose from the rope. After freeing his hands, he was
able to untie one of the cloths around his neck which cloth
had served cither as the gag or the blindfold. He placed the
rope and the cloth that he removed in his jacket pocket, possibly
nis lower right pocket. He pushed the cloth which he was unable
to untie down low on his neck and closed his jacket high around
his neck to hide the cloth.
Being confused and afraid he sat outside the Safeway
Store near the intersection of College and Claremont Avenues
for several minutes to decide what to do. He observed a taxi
cab stand across the street on Claremont Avenue. He entered as
cab at that location driven by a white mala cab driver, and
requested the driver to take him to his sister's residence
