definite fact that Verne Miller was the person in the apartment with Vivian.
This conclusion wes reached for the following reasons:
1. The greeting by Bobbie Moore, which indicated that she had
not seen ‘him for some time.
&, Tue fact that Bobble referred to Vivian as Vi, instead of Clara
as Vivian was known at the apartment.
. j S. The telephone call from Vivian to Bobbie, advising Bobbie that
"Verne wants you to put away the Auburn".
4. Vivian had been observed entering her apartment by the writer,
at which time she put her key in the lock and found that the
door was bolted. She then identified herself to the person with-
in the apartment, who unbolted the door. She then appeared to
open the door and it appesred to the writer that the door was
also chained, and it took Vivian three or four minutes to fet
into her apartment.
S. The further fact thet during the two days and night of the sur-
veillance, the men in Vivian's apartment had not left the apart-
ment, and he was heard on the telephone ordering some food fren
a delicatessen,
6. The fact that the cer had arrived from New York and that Bobbie
had carried his grip up to the apartment, instead of Miller carry-
ing it up himself,
All of these facta indicated to the writer and to practically
everyones on the scene that the person in Viviants apartment was Verne Niller.
At this time arrangements had not, as yet, been made for the surveillance
from the room in the apartment in the rear of the Sherone, which arrangements
heave been previously described. At this time Agent Hartin was instructed to
endeavor to make the arrangements and at the same time to telephone you and
to tell you thet the writer felt that all indications were thet the person
4n Téeionts apartment was Miller, and that there was a strong possibility Miller
had becone suspicious and would attempt to leave the apartment if we endeavored
to maintain the cover longer, and that in my opinion and in the opinion of the
officers and the majority of the Agents, that the apartment should be crashed
at five o'clock on the afternoon of November lst. Agent Hartin was also in-
structed to advise you that Agent Keating was of the opinion that the apart-
ment should not be crashed, as he felt we would have a better chance of taking
Killer in the corridor when he came out of the apartment. On his return to
Room 207, Agent Hartin informed me that he had advised you of the above and
that you had talked to the Director, and thet the Director did not want the
apartment creshed until we could make a positive identification, and if pos-
sible to give Agent Notesteen an opportunity to view the person when he cam
out of 211. Hartin also advised me that he had made the arrangements for 4
place in the adjoining apartment, to watch the roof of Apartment 211 and the
