Upon receipt of these instructions, it was deemed advisable not
to have any police cars with officers near the apartment, and Agents
Van Wagoner and Rice were stationed in an old Ford Sedan, with Texas License
Plates, opposite the area way, at which place they could command a view of the
area way and also of the Galt Avenue entrance. They were armed with their
pistols and a machine gun.
In the meantime, Pobbie Moore was seen carrying a newly pressed
uit of clothes up to Apartment 211 and it was thought that Miller and Vi and
fore were probably planning to go out that night, and it was thought that
sthey woud probably go around 9:30 or 10 otclock.
From 6 P.M. on November lst, Mra. Rogera and Agent Notesteen
were placed in the kitchenette of the apartment, so that both parties could
eet a view of the party expected to come out of 211. I was to remain in the
kitchenette in order to give a “chop” signal to Van Wagoner to signal the squad
thet "he is here”. At this time arrangements were made for Officers Freemth
and Curtin, and Agent Keating, to teke the left door entering to the elevators,
in case Miller got up that far, end for State Officer Fempster and Agents
Van Vagoner, Nichols and Madula to rush to the right entrance to the elevators.
If identificetion were made of Miller before he reached a point to get to the
elevators, everyone was instructed, of course, to take Miller and not hesitate
to shoot him if he mde the slightest move. Agent Madela was instructed to stey
in front of 207, to command a view of both corridors leading to fire escapes,
end at approximately 8:30 Agent W. 4. Smith was instructed to co domstairs
to cover the lobby at the bottom of the stairway, and also the Sheridan entrance,
and to inform Agents Rice and Lockerman (Lockerman had replaced Van Waroner
in the car) thet indications nere that Miller would be leaving the epertment
and to keep a close lookout from then on. Approximately five or ten minutes
elapsed after Agent Smith proceeded to the lobby and this Agent had left the
kitchenette in order to see if the officers and Agents were lined up properly
near the door, so that immediate access could be made to the corridor. While
the writer was returning to the kitchenette, Agent Motesteen ceme into the room
and said "That's him", an@ at approximately the same time Agent Madale had gotten
a good view of the person, who was running around the eerner toward the entrance
to the stairway and elevator, and was positive that he was Verne Miller. The
officers ran to the entrances as plenned. Officer Freermuth in the lead, fol-
lowed Miller down the steps. The writer dashed out in the hall and saw Vivian
going back toward the fire escape, at which time he grabbed Vivien and tured
her over to Agent Van Wagoner, with instructions for Van Wagorer to hold her in
Apartment 207. I then ran down the steps to the lobby and heard shots, ard ran
out in the street and found that the cer had gone up the etreet. I immediately
telephoned a police alarm and asked the police to dispatch a radio that Verne
Miller, notorious killer, had just escaped from the Sherone Apartments in a
cream colored Auburn Sedan with Illinois License Plates, and to broadcast an
elamm. <About two minutes later I ascertained the nurber of the license plates
