On Friday, August 20th, I sont you a telegram urging you to
reconsidcr your intentions or attempt to sign Mine "B" to a contract with
the United Hine Ucrkers of America, In this tclegram I pointed out to you
that the employees of Mine "B" wore membscs of she Progressive Minors of
Aneriet, holding their membership in Loca. Union #64, P. }. of A. at
Springfield, which has jurisdiction over you: mine, but I am sorry to state
that the tclegram was entirely ignored ty you since I have roceived no reply

"Por the sake of refreshing your memery I call your attention to
the fact that your mince has been opurating under contrect with the
Progreseive Miners of /merics ever since it3 inception, and your mine
wos operating “ith tha Frogressive Mincre cn March 3let, 1957, the date
upon which the contract expirca. ,
"TJ eonll your attention to the fact that your mine, like all other
mines throughout the stato which are under jurisdiotion of our organization,
wore permitted to continue operating under the terms and provisions of the
contract that expired March 31st, 1937, pending final scale negotiations
and the making of a permanent ogreenent.
"J call your attention to the fact that on April 2nd, 1957 you
signed o tentative agroemont with our organization, accepting the above
torms and you continued operating your mine under contract with our
organization.
"J call your attention to the fact that tho April 2nd tentative
agreement which you signed carrics with it any and all features in the
final making of en agroement that ie binding on both parties. This provision
just mentioned provided for the retroactive feature that was agreed to in
L joint scale confercnce on April 6th, 1957, @ copy of which was presented to

the Apri entative agreement for reasons bestinown to yourself and
on the strength of the tentative agreement that you signed on April 2nd
being binding upon you until such time as a pormonent agroement could be
made, your mine wos permited to continuc operations. It was common
knowledge to this office and to the membership of Local Union #54, P. M. of
A., Whose entire membership are employees of your mine, that you were oO
collaborating with Ray Edmundson, provisional president of the U. HW. %. of
A., and that you wero attonding sooret meetings with lr. Edmundson and other
U. Ms %. of A. provisional reprosentativos for the purpose of attempting to
take your mine from under jurisdiction of our organization and place i¢
