Reference is made to the memorandum from W. W. Bromyell to ir. = 2 ea —
- Tracy, dated March 16, 19,9, regarding the above captioned matter, in which
the question is raised regarding the desirabllity taking into consideration
the possibilities of extradition when placing wanted rotices for the ICPC,

The standard procedure followed in cases involving extradition is
for the Investigative Division to oven a fugitive case on the subject after
receipt of a request through diplomatic channels for extradition. Qtherwise,
there is -no assurance that the foreign government will actually request
extradition. It wowld not appear feasible, therefore, for the Bureau, as
suczested in referenced memorandum, to open an investigation on an extraditable
furitive, either when the wanted notice is received with no evidence that the
subject has returned to this country, or after the Identification records show
that he has been arrested by the domestic police, but before the receipt of
notification that extradition has been requested through official channels.
It will be further noted the only means of determininy whether or not
the wanted notice refers to an extraditable case would be to refer the wanted
circulars received from the ICPC to the Criminal Division of the Department for
rulinzs as to whether each individual case was covered by an extradition treatye
This would place an wwarranted burden on the Criminal Division and each case
yould be hypothetical in that the Bureau would have to request advice as to
whetner or not the subject could be extradited if he should return to this
country.
