UNCLASSIFIEDA/LES- (U) Crimes Against Children and Human Trafficking Program Policy Guide 4.2.6. (U) 24-Hour Presumptive Clause (U) In a case where there is evidence of a kidnapping, failure to release the victim within 24 hours creates a rebuttable presumption that the victim has been transported in interstate or foreign commerce. A federal investigation may be initiated, however, even before 24 hours have elapsed (before the presumption of federal jurisdiction has taken effect). It is not necessary, therefore, for the FO to wait 24 hours to initiate a child-abduction investigation. (U) Likewise, it is not necessary for the evidence to show that the victim was actually moved FOs must not hesitate to open investigations when factual circumstances reasonably indicate a violation of Title 18 United States Code (U.S.C.) Section ($) 1201.. 4.2.7. (U) Child Abduction Rapid Deployment Team. (U) The Child Abduction Rapid Deployment (CARD) Team is designed to deploy FBIHQ and FO investigative and intelligence personnel with proven experience in child-abduction matters as a rapid, on-site response to provide investigative, technical, and resource assistance to an ADIC/SAC during the most critical period following a child abduction (particularly in a nonfamily child abduction). The missing or kidnapped child must be entered into the National.. Crime Information Center (NCIC) system before a request for CARD Team assistance may be made. Local agency entry into NCIC is sufficient to request CARD Team assistance; the FO is not required to make a duplicate entry into NCIC. The FO must initiate an investigation, using the appropriate case classification, and the request for CARD Team assistance must be approved by the ADIC/SAC or his or her designee. Requests for the team must be made to the CACHTU. duty SSA. CARD Team deployments will be funded by the CID. (U) The CARD Team is responsible for completing a post-deployment survey within 30 business days of the conclusion of a deployment 4.2.8. (U) Critical Incident Response Group (CIRG), Investigative & Operations Support Section, Behavioral Analysis Unit: Crimes Against Children. (U) BAU-3 can provide immediate investigative support through: .(U) Violent crime analysis.. .(U) Offender profiling. .(U) Investigative strategies.. (U) Interview and interrogation strategies.. .(U) Behavioral characteristics of unknown offenders.. (U) Coordination of technical and forensic resources such as evidence response teams: laboratory services; and the utilization of the most current expertise available in matters involving the abduction and mysterious disappearances of children.. (U) To request BAU-3 investigative support, FOs should contact their respective BAU. coordinators. With ADIC/SAC approval, FOs may request the support of BAU-3 personnel for. investigations through telephone consultations or through immediate on-site deployments. It is standard procedure for BAU-3 to deploy with the CARD Team. 9 UNCLASSFIED//LES
