Hearing on a motion te suppress eyewitness
identification evidence against Theodore R. Bundy,
charged with kidnaping, opened Wednesday and was
quickly closed to the public, including newsmen.
Third District Court Judge Stewart M. Hanson Jr.
* adopted an order filed earlier by City Judge Paul G.
Grant to restrain the publication or showing of
pictures of the defendant or witnesses.
The motion to suppress, filed by one of Bundy’s
attorneys, Bruce C. Lubeck, contends that a lineup, in
which the kidnap victim identified Bundy as her
assailant, was improperly conducted.
Bundy, 29, 656-lst Ave., was charged in October
- with kidnaping in connection with a November, 1974,
incident, in which Carol DaRonch, 19, said a man took
her by force from a suburban shopping mall. She said
she managed to escape after he got ner into his car.
The defense motion contended pretrial confronta-
tions between Bundy and Miss DaRonch “were
conducted in such an impermissibly suggestive
manner as to give rise to a very substantial likelihood
of irreparable misidentification.”
Police have said Bundy was identified by Miss
DaRonch in a lineup last Oct. 2. The defense motion
Says everyone in the lineup except Bundy was a
policeman.
Judge Hanson said the Wednesday hearing was
not on trial merits but on evidentiary questions,
including some of constitutional proportion.
He said he was granting the motion to exclude the
public because of the defendant's right to a fair and
impartial trial “free of any taint on the jury.”
The hearing will continue~Ehursday at 10 a.m. in
Judge Hanson’s court. - “
