Berndon v. Lowry (1937) 301 U.S, 242 «.. a on VEER ge
Berndon was convicted by a Georgia Court ef attempting to
incite insurrection by calling and attending public meetings and making
speeches to erganize the Communist Party of Atlanta to resist and overthrew
the authority ef the State. The Supreme Court reversed the cenvictien,
holding that the statute, as construed and applied in this case, did not
furnish a sufficiently ascertainable standard of guilt.
Kessler v. Strecker (1939) 307 U.S. 22
An alien js not deportable on the ground of membership in the
Communist Party if his membership has ceased at the time ef his arrest
under a warrant of deportation,
Browder v. United States (1941) 312 U.S. 335
Ear] Browder made false statements in his application te obtain
&@ passport and used the passport to establish his identity and American
citizenship upon returning to this country. He was convicted of willful
use of a passport obtained by false representations, The Supreme Court
held that the use made of the passport was within the scope ef the statute
and affirmed the conviction.
Schneiderman v. United States (1943) 320 U.S. 118
The Supreme Court reversed a judgment of a lower court which
cancelled a certificate of Naturalization on the ground that it had been
procured by fraud because the petitioner concealed his Communist affilia-
tion from the naturalization court, It held that the goverment had not
proved with requisite certainty that the attitude of the Communist Party —
