One of the police officers observed the black male to carry 4 silver handgun. The officers chased the individual, but he eluded capture. Prior to the chase, witnesses at a nearby MacDonald's Restaurant observed two black males at the ABC Liquor store, heard the shots, and then observed the black males run when approached by the police officers. The two witnesses proceeded to chase one of the black males, but he also eluded capture. During the chase, an Armor Lite catalog/brochure was dropped by one of the black males. Later, on or about October 22, 2002, the FBI Laboratory determined the print on the catalog to belong to a Lee Malvo, B/M, DOB: approximately 5'5", 125 pounds, FBI No. The investigation revealed that Malvo was from Jamaica. b6 Montgomery Police Depart ‘gs 3 Sstigation of Maly b7c revealed that he and his mother, also known ae] B/F, DOB; —~——S—=«éi entered into the United States illegally aboard a foreign ship which eventually docked at the port in Miami, Florida. Subsequent to arriving into the United States, obtained work at a Red Lobster located in Fort Myers Florida, using a false DoB:~~ ] and a false ssan:C_—_] Co on her job application. The investigation obtained information that Malvo ran away from home and fled to the state of Washington. There he met John Muhammad, B/M, DOB: 12/31/1960. Muhammad is a former military soldier and had been stationed at Fort Lewis, Tacoma, Washington, assigned to the 520th Infantry. The investigation also revealed that Muhammad, nicknamed Malvo, "Sniper". The Montgomer ice Department explained that on or about November, Soon to dquit her job at Red Lobster and moved to Tacoma, Washington. On or about December, 2001, Immigration and Naturalization Service arrested[____] and Malvo for violation(s) of U. S. Border Laws as they tried to cross into Canada from_the U. S. Border and Washington. On or about January 25, 2002,[_____]and Malvo were able to bond out of jail. Malvo had not been seen or heard from until September 21, 2002. The Montgomery Police Department had developed a photographic composite line-up relating to Malvo. This line-up 6 was shown tol a citizen who assisted the police chase %7C subjects after the shooting incident.[( Jhad positively identified Malvo as being at the crime scene. During the chase, was able to reach within 5 feet of Malvo but then lost him. Montgomery Police Officer chased the other subject. Upon review of the photographic composites regarding 2
