TENTATIVE REFUSAL OF PASSPORT FACILITIES TO SUBJECT
On May 27, 1957, Passport Office f{nformed subject
that his passport application of March 21, 1957, was being
tentatively refused under the provisions of Sectien 51.135
of the Passport Regulations. Subject was informed of his
entitlement to an informal hearing at which he could present
any relevant information, It was stated that at any rate subject
would be expected to subscribe under oath or affirmation to
e statement with respect to membership in the Communist Party
as provided in the Passport Regulations.
Section 51.335 of the Passport Regulations refers
- te the limitation on the issuance of oassports to persons ....~....-
supporting the communist movement so that persons who support
the world communist movement, of which the Communist Party
is an integral unit, may not through the use of United States
passports further the purposes of that movement,
INFORMAL HELRING HELD AT THE PLSSPORT OFFICE
On Mey 29, 1957, pursuant to the passport regulations,
an informal hearing was held at the Passport Office with
respect to subject's request for passport facilities. Subject
was Frepresented-at the hearing by his attorney, LEONARD E,
RBOUDIN, At the hearing, subject refused to submit an affidavit
and refused to answer questions relating to Communist Party
membership and sise refused to answer questions or to offer
explanation of varied activities abroad in support of the
comiunist movement,
In view of subject's actions, he was informed that
due to his failure to compiy with the passport reguiation, the
Department of State was constrained to withhold further considera-
tion of his request for passport facilities until such time as
subject was willing to comply with the regulations,
