Dear Mr. Breniman:
I enclose herewith copy of the issue of the "Tulsa Daily
Worid™, under date of Thursday, September 19, 1929, and call your atten-
tion to an editorial under the heading "Government Espionage", on page
8 thereof.
You will recall this is the matter about which I talked with
you when you were in Tulsa recently end in the office. The particular
hing of interest to this District is the W. K. Hale trial at Pawhuska,
mentioned therein.
This articie charges that the government prosecutors, through
the government ag S, constantly watched the jury or ju rs for weeks;
while the facts 2 that this is not true. The governmetlt officers or the
government prosecution had no interest in watching the jury at all in the
trial of this case, and did not do so; and none of the other matters men-
tioned in the article with reference to the Hale trial are true so far as
I know.
The matters mentioned therein with reference to the deal between
federal prosecutors and DickpGregg (a convict witness, so I am sdvised) are
not the facts. My information is that Dick Grege was released to the State
of Oklahcma by the Kansas Penitentiary authorities for the State of Okla-
homats use in the trial of its state cases at Pawhuska, and was in cherge
and custody of state officers when he made his escape, and the government
had nothing to do with it.
I think the gentlemen who wrote this editorisl ought to be in-
terviewed, and it shouid be ascerteined where he got his information with
reference to these things, and probably he and his informers, if ary,
should be called before a federal grand jury to disclose these alleged vio-
lations, if they have any knowledge thereof, wiich I eam satisfied they have
not,
