I 1 I , 1 , | 92 I 1 92 2 NK 9-2084 PJC:amd the subject receive psychiatric study or treatment, but that this is more properly the responsibility of the local authorities; 4 he explained that under Federal Criminal Procedure a subject cannot be afforded psychiatric treatment until he is convicted which could take some time and he felt local authorities would be able to take more direct I action; " On September 14, 1967, it was brought to the attention of Mr. PJROWITZ that the subject had also sent two letters, one to President JQHNSON and one to Mrs. JOHNSON, at the White House, Washington, D,¬, This information was not available at the time the matter was originally presented to Mr. HOROWITZ, Mr; HOROWITZ advised that this additional information does not change his original opinion to decline prosecution in this matter, _ On September 15, 1967, the contents of the letters sent by LIVEZLY were brought to the attention of Assistant Prosecutor ALBERT SCARDUZIO, Camden County Prosecutor's Office, Camden, New Jersey,  ¢ Mr. SCARDUZIO advised that he does not see any way subject can be committed to mental institution for psychiatric evaluation unless he voluntarily signs-own commitment papers. SCARDUZIO stated that the normal procedure for having someone committed in New Jersey is for a close relative, residing with him, to have subject examined by one or more physicians who would recomend committal based on examination, The commitment would be for a temporary ten day period following, which the individual could be committed permanently upon the recommendation of the institution and proper papers signed by a county judge, SCARDUZIO advised .. ' that as LIVEZLY lives alone, has no close associates or relatives, he does not feel this could be accomplished; SCARDUZIO pointed out another way oi committing subject would be if he were arrested on local charges and the arresting agency, at its discretion, could immediately commit the individual for a ten day temporary period. This could be made permanent upon the recommendation of the institution, SCARDUZIO pointed out that on the basis of 22
