MEMORANDUM FOR THE DIRECTOR : oe
Pursuant to the request of Mr. Clegg to furnish in- —
formation as to why Identification Orders, #1190 - Robert ~. .
GOBrady, with elieses, and #1192, Jim*Clerk, with aliases, -.
were not promptly re-issued, pleased be advised that when
these Identification Orders were first issued there was some
indication that Hervey Belley and his ten associates, in-
cluding the sbove, were guilty of perpetrating the Kansas 2
City massacre. This gang had esceped from the Kensas Stete ~ © --.:
Fenitentiary et Lansing, Kensas, on May 30, 1933 and Ident-
ification Orders were issued on ell of them under date of -
June 22, 1935. Based upon evidence gathered by the Division,
an Indictment wes returned at Kansas City, Missouri, Septem-
ber 1, 1933 charging Brady and others with conspiracy to
deliver a Federal prisoner, Clark, however, was not nemed
in this Indictment, there being no evidence to implicate him.
Both of the above Identificetion Orders were cencelled under
date of Cctober 12, 1933 by Apprehension Orders 71190-2812
and #1192+282, respectively, inasmuch as both fugitives were.
apprehended at Tucumcari, New Mexico, on October 6, 1933, and.
returned to the Kansas State Penitentiary from which they a5
gain escaped on January 19, 1934. Information was received
from the Esnsas City Office, on January “2, 1934, advising
that subject Bredy had bean shot end Killed while resisting _
arrest at Faola, Kansas. The Kansas City Office has been a
telegraphically instructed to obtain fingerprints from the | .-.':
corpse of Brady end to forward them to the Division for com- ... .
parison. With regerd to Jim Clark, who is not under indict--—~ .
ment, but whose apprehension was originally desired by the . _
Division for questioning in connection with the Kansas City. ~~
cese, it appears from a review of the file that subsequent ..” ~
to his apprehension at Tucumcari, he was thoroughly questioned:
