Re: VERNON C. MILLER, with alisses, FUGITIVE,
I.0. #1195, et al,
OBSTRUCTION OF JUSTICE (Endeavor to Deliver
Federal Prisoner Frank Nash).
it hes definitely been established thet Vivian Matthews, the
paramour of VERON C. MILLER, had been occupying Apartment 211, under the
alias of Mrs. Clera Hays, since August 27, 1935, At abort 6:20 p.m. on
October 3lst, 1933, a man entered this apartment who answered the description
of the fugitive Miller, although his identity had not been definitely
establisheds
On the afternoon of November lst, 1933, Special Agent E. P.
Guinane, who was one of the supervisors of this investigation, after 6
conference with various police officers and agents decided to raid Room
211 at the Sherone Apartment Hotel et five p.m on said dete, Sometime
before five p.m, Agent Guinane adviged all persons present in Room 207,
Sherone Apartment Hotel, that the raid was not to be inetituted at five
pem. due to the fact that instructions had been received from the Director
not to raid Apartment 211 unless positive identification of Miller had been
made and that if positive identification hed not been made within twenty-
four hours, then to raid same, At about 4:15 p.m. November lst, 1933,
from conversations heard over the telephone between Bobbie Moore and Vivian
Matthews, it appeared that possibly the man believed to be Miller would
leave his apartment for a trip somewhere, All agents and police officera
in Room 207 received instructions from Special agent Guinane to hold them-
selves in readiness to take Vernon ©. Miller in the elevator foyer on the
aecond floor of the Sherone apartment Hotel in the event that the man who
was occupying 211 was positively identified as Miller.
This agent hed instructions, if Miller was positively identified,
to immediately leave Apt. 207 with Sergeants Freemuth and Curtin of the
Chicago Police Department and to follow the fugitive to the elevator foyer
door which was nearest Miller's apartment. Other agents were designated
to entar the elevator foyer through another door at the same time,
At about 8:30 pom. Miller was passing “oom 207 and entering
the elevetor foyer he was positively identified by Agent Notesteen, On
signal of identificetion Agent Medala immediately opened the front door
and agent followed his inetructiona and got on the elevator foyer with the
