MEMORA DUS TOR ACTING SPECIAL AGENT IN CHARCE D. O. SMITH:
Reference is made to my memorandum of November 4, 1933, relative
to the events which took place at the Sherone Apartnenta on the evening
of Novexber lst, 1935, at which time an effort was made to apprehend
Vern Miller. .
As indicated in the second paragraph of that memorandum the writer
understood Special Agent Guinarne to instruct him to proceed from apt. 207
to the Sheridan Road entrance of that building and keep that entrance
covered in the event there was some slip upstairs and thet an exit should
be made at that entrance, As is further indicated in that memorandum agent
was unable to leave the apartment immediately and during the period of wait-
ing there was some discussion among the various agents in the room to the
effect that Age:its Lockerman and Rice, who were loceted on Galt Avenue,
opposite the area Way back of the Sherone Apartments, should be contacted;
consequently, after agent descended from Apt. 207 he proceeded out the
Sheridan Road entrance and over to Gelt Avenue, with the intention of con-
tacting Agents Lockerman and Rice, but Vern Miller had proceeded out of the
apartment and gotten into the waiting automobile immediately after agent's
exit fron the apartment so that egent was unable to reach Agents Lockerman
and Rice before the police officers and other agents came out of the Galt
entrance and sterted to fire upon the car in which Miller was driving away.
AS agent understood his instructions he was to cover the Sheridan
Road entrance and he did not receive any apecifie instructions to contact
anyone downstairs, although after the original instructions to cover the
Sheridan Road entrence had been given there was a discussion concerning
the advisability of contacting any egents which might be stationed in Galt
Avenue and consequently agent went down and after observing thet there was
no ons in the vicinity of the Sheridan Road entrance, he proceeded sround
into Galt Avenuee
