Both are sentenced to life end both are so hardened in crime that we believed it to be a lose of time to further question then, agent in Cherge Vetterli could not positively identify Brady as being the wielder of the machine gun directed at him, He said there was a close resemblance but that he could not say positively and that he would like to see him full dressed and wearing a hate Vetterli said he never saw Clark before to his recollection. Clark was taken to the New Kexico Penitentiary at Senta Fe on October 11, 1933 by Sheriff 4llen and deputies. Agant Street and I remained at Tucumcari as Bredy was a prospective Federal Prisoner while Clark wes not, and the doctor had not agreed that it would be safe to move Brady. On October 11, 1933, United States Marshal Tondre of New Mexico, accanupmicd by two deputies and United States Attormy Berker arrived at Tucumcari with certified copies of indictment and warrant charging Brady and others with conspiracy to release Frank Nash. Fugitive complaint was filed at Tucuncar{ and the United Stetes Comissimer held a hearing in Brady's room at the hospital at which time Brady plead not guilty and was held in default of $25,000 bond. Brady had previously refused to sign a waiver of removal, On the night of October 11, 1923, Dr. Thorpe advised that Brady was so improved that he could be moved with safety in an ambulance, United States Marshal Tonire, through Agent Street, arrenged for an ambulame, and at 5:10 AM, October 12, 1933, Brady was removed froz the hospital et Tucumcari and at 13:15 4M on the same day he was placed in the New Mexico Penitentiary at Santa Fe, apparently heving suffered no 411 effects fron the journey. It appearing that sone time would be required in Which to move Brady to Kansas City, I wired the Division I was leaving for Dallas,
