"On about Jenusry 3. 1938, the NLRB issued its order certifying
the PRT organization es the porgaining agent at Mine "B" Coal Company.
"On about January 4, i938, Mr. ELSHOFF made anothor attempt to
open the mine with the United Nine Workers, At about 6:50 a.m, January 4,
1938, I, as president, together with approximately 350 Mine “B" employees
went to the mine in ordsr to rcport to the management that our mon were
ready to work as members of tha Frogrcssive Mine Torkors. “hile our
members remained on the highway I versonally went to the mine office to
consult with the managoment regarding the situation. At tho mine office
I met with United States Marshals whe wore there to enforce the injunction
previously granted, and found two representatives of the United Mine
“orkers -- namely, | CLASES. - in conference
with Mr. OSCAR FALCETTI, e-Etno superintendent, fice,

two United Mino “Yorkers reprosontetives to retiro from the room. I advised
Yr. FPALCETTI that practically all of his mon wero out thore on the road
reudy to go to work as members of the Progressive Mine “orkers, and in
conformity with tho decision mde in the labor board election, and under
the board's order, Ho refused to consider our proposal on the ground
as stated by himself that he had no authority to deal with the Progressive
Wine “orkers, and that his hands wero tied, end was sorry there was nothing
he could do, I asked for “tr. ELSEOFF to which Nr. FALCETTI replied that
Mr. ELSHOPF was not there, I requcstcd him to call tr. ELSHOFF and have
him come to the mins immcdictoly to discuss the case with me, He statod
