Inquiry should be directed to ascertains
(a} Did Elehoff express any opinicns as to whether he
wanted U.M.W. to win the election? .
(b>) When he learned of the result of the election, did he
immediately begin to make plans to reopen the mine?
{c} Did he connive in any way to favor the U.M.W. cam
paign?
(9) Elshof!, on Maroh 14, 1941, Signed a Closed-Shop agreement with
UMeWe
The U.M.W. was certified by the Board on March 6, 1941.
Eight days later, Elshoff signed a closed~shop agreement with U.M.W.
He thus accomplished in eight days what he had failed to accomplish
with the Progreseives in four yearse Inquiry should be directed to
ascertains
(a) When did Elshoff first indicate a willingness to sign
a closed-shop contract with UMW? (I distinguish hers between
negotiating a contract, which he was obligated to do because of the
certification, and signing a olosed-shop agreement, which he had
refused to do with the Progressives after they were certified on
January 4, 1938,
(b) The NLRB files indicate that before Elshoff did sign
the contract, he notified the Regional Director of the Board that
he would not sign until the Supreme Court's decision had been
modified.
Apparently he raised an absurd legal condition in this
respect. Jt is believed that this was simply a gesture on his
part to give his action an appearance of impartiality. Inquiry
should be directed to ascertain whether he raised this contention
in good faith or note
