wo , which sets forth the facts surroundin; the shooting of Dillinger. The
¥ r affidavit wets forth the prelininary contacts with representatives of
yas the East Chicago, Indiana Police Department, and the informant, describes
the stationing ef Agents about the theatre, mentianing the fact that
Epecial A;ent B accompanied Mr. Purvis to the Biograph Theatre at about.
157 P.M. on the night of July22, 1934, states that Wr. Purvis ebserved
John Dillinger andtwo women enter the theatre and that the Chicago Bureau
effios and Sergeant Zarkovich and Special Agent ¢ were notified, and that
the entire theatre was imodiately covered. This affidavit states that the
various Agents maintained their positions in as inconspicucus a manner aa
_ possible wtil about 10:40 P.M. on the night of July 22, 1934, at which tins

foot in a south-easterly directions
The affidavit of Mr. Purvis and Mr, Cowley then states "Upon
Adentifyirg Dillinger, affiant Purvis gave the pre-arranged signal for |
the men to close in. Special Agent BE, C, D, B and affiant Purvie immedi-
ately surrounded John Dillinger, all bein; stationed on the south-east side
of the Bio:raph Theatre. Officers Sopsic and Stretch of the East Chicago,
Indians Police Department had assumed & position et a point in a north-
westerly direction from the theatre, and at the time ths signal was given
Sergeant Zarkovich, who had been stationed at a point diagonally across the
street from the Biograph Theatre, ran sorvse the street and notified Officers
Sopsic and Stretch, who had not seen the signal, Captain O'Neil, Officer
Conroy of Captain O'Neil's squad, had assumed roving positions during the |
entire covering of this matter. John Dillinger was seen to draw his gun,
which was later found to be a .880 automatic pistol, from his right trousers
pocket. He aseumed a dodging semi-crouchirg position and drew his gun
from bis pocket. At that tie he was shot by Special Agent FE, D, and
C, who fired ons shot each, except the last named, who fired threes shots,
Immediately after the shooting, the above mentioned automatic pistol was
taken from his hand and an ambulance was called, tnsamnch as i appeared
. he wes not dead,"
After the shooting of Dillinger, otatenents were taken in the
Chicago Office fron all of the Special Agents who participated in any
manner in the shooting of Dillinger. Pertinent parte of the statements

Bpecial Agent C, under date of July 25, 1954, submitted a
mancrendum in whioch he states: "A,ent stepped in a doormay, where Special
Agent D was standing, and it was acreed that when Wr. Purvis gave the
wignal, that Dillinger was leaving the theatre, if he had gone south,
