2 SF 7- TVF:sac : After he-was tied with his hands behind his back. _ with a nylon rope, the man started hitting him in the back of the head with what he later learned was a wine bottle at least three times. . . . At about this time, he noticed through his front door, which was still open, that the other two in the kitchen had dragged his neighbor across the hall, STEVEN, an Oriental . male, into his, WEED's, apartment and were tying him up and threw him face. down with his head between his, WEED's, legs. It was at this point that he started to pretend that he was passed out from being hit over the head, and he started to roll over when he was hit the fourth time, and he thought to himself that he would not have another chance and somehow he jumped up to his feet with his hands tied behind his back and started screaming and yelling dodging around through his living room and managed to get to the back sliding glass door which was double latched. He said somehow he got his hands | untied and the door open, and he then noticed that the three persons who had broken into his apartment were running out the front door with his fiancee. . He ran out the back door, still groggy from being beaten and kicked in the face, and climbed over several fences as he thought they might still be following him. A few houses away, he exited through the back yards onto Parker Street, and at that time he noticed a Berkeley police car already arriving in the area. He said that neighbors, identities not recailed, tried to get him to lie down and someone helped him back to his apartment where he told the Berkeley Police Officers who were already in his apartment what had happened. He said he recalls the white female saying at one time something to the effect, "We'll have to get rid of then, they saw us". He said he did not see any other weapon other than the rifle carried by the black male who kicked him with his booted foot repeatedly in his face and hit him over the back of the head with the wine bottle.’ - ia = z i
