Tamm ATOMIC ENERGY ACT - APPLICANT _ — xz . Tele. Room __ This is to advise the Atomic Energy Commission ad! Gandy requested a background investigation of the above-captioned individual, who is presently the Governor of California. Because of his position as a member of the Board of Regents of the University of California, which ° position has been classified as a highly sensitive position by the Atomic Kiba” Energy Commission, the Atomic Energy Act of 1954 requires that a full je investigation be conducted by the Bureau. Governor Brown, as a member wa of the Board of Regents of the University of California, will have access to restricted data. Even though the Atomic Energy Act of 1954 requires that a full investigation be conducted concerning individuals having a highly sensitive position, it is believed that the Director of Security, Atomic Energy Commission, should be contacted to determine whether an investigation of Governor Brown should be conducted. If the Director of Security, Atomic Energy Commission, reaffirms the request for the investigation, it is believed that the investigation should be ordered, since it is felt that the Bureau would have no alternative, in view of the Atomic Energy Act of 1954. In event the investigation is ordered, it is felt that Governor Brown should be advised of the reason for . the investigation and the fact it is being conducted at the request of the Atomic Energy Commission. Bureau files reflect that Governor Brown has never been investigated _by the FBI. In an article in the San Francisco Examiner, a California "newspaper under date of 7-16-58, Brown, then Attorney General of California, charged the FBI Uniform Crime Reports presented California in an "unjustifiable and unfavorable light," because of the manner in which A the statistics were compiled. He subsequently stated the article was not, " in any manner, meant to be derogatory of the "great work" being done by | the FBI.
