SAC August 20, 1946 Hotel would come up to the hearing with high-price lawyers and technical experts. I asked him if the builders of the Flamingo Hotel were not already on notice that his organization was conducting an investigation, and he ad- mitted that they had already appeared at the first hearing with high-price lawyers and technical assistants. GR... proposed that we hold off our investigation util after the CPA hearing Septenber 5. He said that if both the CPA and the FBI investi- 7% gate this matter we might both fail, but that if CPA alone investigates it the b chance of CPA failing is less. However, he stated that if the CPA faila to make its case then they will turn the matter over to us. I told him that he himseit stated that we would be going over the same investigation, and I pointed out that if that ts true that if the CPA fails then the FBI fails, He adnitted that this was true. He said that they thought they might try to get additional plans used by the construction company. I then aac 2 he thought that the CPA could make a case that would "stick." He replied that he did think so, otherwise, they would br net proceed with further investigation. Weaturally he qualified tad a bn atating that it depends on what evidence is secured, that if the same evidence is secured that he feels can be secured the stop order of the CPA can be made final. We asked QE: + recourse the builders have in the <>. event the stop order is made final) amd they stated that they can appeal to e- the Chief Compliance Officer of the CPA after which they can have recourse to the Federal courte for « restraining order. Wen asked if there was anything else that I wanted, and I told him that we had not received anything that we came for, that what we bx wanted was the full facts on this entire matter. I told him that apparently he had no intention of furnishing that to ua and his attitude was that he would have to secure the authority for him to furniah thia information to us from his superiors in Washington.
