On March 2, 1931, Federal Judge Jemes H. Wilkerson sentenced him to
serve six months in the Cook County, Illinois, jail. His attorneys immediately
gave notice of appeal. The United States Circuit Court of Appeals for the
Seventh Circuit, on motion of counsel for Capone, dismissed this appeal.
Federal Judse James H. Wilkerson, in santencing Capone on October 24,
1931, for violation of the Income Tax Lans, provided that Capone's sentence for
Contempt of Court should be served concurrently with that for the violation of
the Income Tax Laws.

Bureau of Investigation reflected the folloving criminal record for Alphonse

AS Alphonse Capone, #90725, arrested Philndelphin, Pennsylvanie,
Police Department, May 16, 1929; charge, suspicious character and
carrying deadly weepons.
As Alphoneus Capone, #7-5527, received State Penitentiary,
Philadelphia, Pennsylvania, August &, 1929, from Philadelphia;
crime, carrying concealed deadly weapons; sentence one year.
As Alphonse Capone, #3563, arrested Miami, Florida, Police
Department, May 6, 1950; charge investigation - vagrancy;
releesed on writ, Vey 8, 1930,
