UNCLASSIFIED/LES (U) Crimes Against Children and Human Trafficking Program Policy Guide (U) FBI personnel may not direct a third party, whether a citizen complainant or LEO, to go online in any undercover capacity. b7E (U) Because all online undercover activity must be recorded, each IINI OCE must provide written, informed consent to be monitored, and the consent must be documented with an FD)-472 Telephone DeviceConsent and/or an HD-1O7lConsent To Monitor Content Of Electronic Commmicatims... (See D10X: subsection 18.6.1.5.1.2.) Additionally, an employee must obtain prior chief division counsel (CDC) or OGC review and SSA approval for consensual monitoring of communications if the information likely to be obtained is relevant to an ongoing predicated investigation. CDC or OGC review and SSA approval must be documented with an FD-759 "Notification of Authority Granted for Use of Electronic Monitoring Equipment-Not Requiring a Court Order' and must be serialized into the appropriate investigative electronic surveillance (ELSUR) subfile. (See DJOX3 subsection 18.6.1.5.1.) The UCO case agent must instruct the OCE to allow the target of an investigation to set the tone, pace, and subject matter of the conversation during online dialogue. (U) Subject to the below exceptions, as applied, OCEs may not upload, transmit, or forward pornographic or sexually explicit visual depictions in an undercover capacity (U) See Dl0X subsection 18.6.1.6.1.2, "Consensual Computer Monitoring of Parties Outside the United States," for communications with a subject believed to be located outside the United States.d (U) IINI OCEs may consider uploading and transmitting files for investigative purposes provided that the files are approved and/or corrupted under one of the scenarios described in subsections 4.9.6.1.-4.9.6.5.: 4.9.6.1.
