insurance under option one, on the basis of her age of sixty
years, payable at the rate of $68.l0 per. month in continuous
life instaliments beginning April 3, 1945, with 120 installments
certain to be paid. The principal beneficiary died Oetober 25,
195l, after receiving a total of seventynine installments.
The Veterans Administration advised that. since the contingent
beneficiary predeceased the principal beneficiary, the remaining
fortyone installments are due and payable to the person or
persons within the class specified. The Veterans Administration
to the remaining fortyone installments, but her claim was
conteated by JAMes M. KINLoch, a half brother of the veteran
who resided at 246 west 138th Street, New York City. CHARLOTTA
BAss is the sister of the deceased veteran's mother. The
Veterans Adminiatration advised that there was no.evidence
that the mother of the veteran ever released parental control
of the insured to CHARiOrTA BAss. He was living with the
latter before he entered the United states Army to take advantage
Of better educational facilities in California..
On May 7, 1954, a cOmplaint was filed by CHARLOTTA
A. BAss, Civil Aetion No. l6764, in the United States District
Court of the Soutnern Distriet of California under the
National Service Life Act of lg4o and World War Veterans Act
of lya4. In her complaint she stated that the veteran was
inducted into the armed forces on July 19, lg43. (Veterans
Administration Statement of Facts shows Eop date as December
1,1943.)
The complaint further set forth an order issued by
the Superior Court of Los Angeles County on July 15, 1941
appointing her as a guardian of the veteran. She claims
that with the death of the real parents of the insured she
