MEMORANDUM IN OPPOSITION TO DEFENDANT'S
MOTION FOR A NEW TRIAL
STATEMENT
The trial of FREDERICo G. RANDACCIO on charges of violating.
18 U.s.c. 195l and 37l commenced on October 26, 1967, in United States
commencement of the trial, the Government turned over to counsel for
in the apartment of Darlene Grann, 5l Essex Street, Buffalo, New York.
This would include the electronic surveillance log which shows that
7:50 p.m. on the evening of February 5, l965, the night of the meeting at
Natarelli's house between FREDERIco G. RANDACcIo, Pasquale Natarelli,
Stephen Cino and Pascal Calabrese.
The electronic eavesdropping device at Darlene Grann's apartment
at 5l Essex Street, Buffalo, New York, was monitored during the evening
cf Feoruary 5, l965, by Clair V. Wambold, a special employee of the Federal
Eureau of Investigation. Mr. Wambold went off duty at midnight that evening,
and Richard R. Walsh, another special employee of the Federal Bureau of
Investigation, assumed the duty of monitoring the device at Darlene Grann's
apartment.
On November 9, l967, counsel for FREDERIcO G. RANDACcIO, Herald P.
Fahringer, Jr., examined Clair V. Wambold and Richard R. Walsh.under oath,
cutside of the Court, concerning their monitoring activities of Darlene
Grann's apartment..
