LEONARD W. GILMAN, Deputy Regional Commissioner in
Charge of Operations, Immigration and Naturalization Service
(INs), Terminal Island, California, advised that on May 10,
197o, at approximately 12:05 a.m., while traveling with
HARLON B.CARTER,Regional Commissioner, in a Government
owned l969 Chevrolet, their vehicle struck and killed a
pedestrian by' the name of LUTHER CURLY on the Riverside
Freeway between Jackson and Van Buren, near the City of
Riverside, California.'
GILMAN said he and Mr. CARTER were on official
business returning from New Mexico to the Long Beach area.
He said they had stopped in Casa Grande, Arizona, for a.rest
and coffee break, and again in Blythe and Indio, California,
where they-had coffee and cokes and serviced their automobile.
He said they had taken turns driving and were mentally awake
and alert, as they proceeded along the Riverside Freeway in
Riverside County, California, at about midnight. He said Mr.
CARTeR was driving the vehicle at this time and he was turned
facing slightly toward Mr. CARTER at the time of the acci-
dent. ..He said their vehicle was traveling on the inside
south bound lane (fast lane) at a speed of approximately 65
miles an hour when suddenly something lurched from the side
of the road less than three feet in front of them, which
their vehicle struck. GiLMAN said it was completely without

stopped their vehicle to investigate.
GILMAN said CARTER backed his vehicle a short dis-
tance down the freeway and then they both rushed to the scene
of the accident on foot where they found a male Indian boy
about 19 years of. age,. stretched out perpindicular to the
freeway, completely motionless, without any signs of bleeding
present, of. the appearance of being dead. He said in examin-
ing the boy, his eyes were open and rolled back. He had no
pulse or any sign of breath and was apparently dead.
GILmAN said he could see. a woman standing across
