Defendart, Raymond K. Procunier, is the Director of the Califernia Department of Corrections; his duties Include but are not limited to the control, custody, and maintenance of prison inmates and facilities for and in the State of California. Defendant, william Curtis, is the District. Attorney for the County of Monterey, State of California; his duties include but are not limited to the investigation Monterey.. 10 At all times mentioned herein the acts and conduct of defendants complained of were and are being committed by defendants, their agents, servants, or employees with the express or implied knowledge or consent of defendants; and at all times mentioned herein the acts of defendants, their agents, servants or employees were committed while acting under color'of State Law.
