The Bureau developed evidence of a sufficient nature to bring charges of espionage against Otto Kuehn and he was tried by military commission in Hawaii. He was found guilty and was sentenced to be executed; however, the sentence was subsequently commuted to Tolso Felt 50 years imprisonment at hard labor. He was transferred to Sullivan Fort Leavenworth, Kansas, on 11-20-42.
