on May 34, 1971, Chief Assistant United States
Attorney (AUSA) HAROLD BAER, JR,, Southern District of
New York (sDNy4, Federal Court House, Foley Square, New
York City (NYC), advised that due to changes in rules in Federal
procedure, United States Commissioner (USC) EARL N, BISHOPP,
SDRY, would not have powers formally attributed to USC's as
of 12:00 noon on May 17, 1971, and that therefore the subject's
preliminary hearing would not be held at 2:00 p.m. on May
17, 1971, es previously scheduled. He stated that the subject's
preliminary hearing would probably be held at 2:00 p.m. on
Mey 1&, 1971, before a United States Magistrate (USM). He also
stated that he had heard that the subject vould waive the
ectahiichment af identity at the prelirinary hearinz at which
time the USM would order the subject to eppear for arraignment
in Washington, D.C, in connection with his indictment by the
FGJ on May 13, 1971.

On May 18, 1971, Chief AUSA HAROLD BAER, JR., SDNY,
Federal Court House, Foley Sauare, NYC, advised that at 2:00
p.m. on May 18, 1971, the subject together witn his attorney
GERALD LEFCOURT appeared before USM HAROLD J, RABY, SDKY, Federai
court House, Foley Sauere, NYC, for @ removal hearing. The
Subject waived tne establisnment of identity and was served with
e certified copy of the indictment which was returned by the
FGJ in Washington, D.C, on May 13, 1971 and which satisfied
probable cause. .
The USM ordered the subject to appear before the USDC
for the District of Columbia, Washington, D.C, on June 2, 1971,
for arraignment in the charge contained in the indictment,
The subject's bail of ¢20,000 was continued to cover his appearance
in the USDC on June 2, 1971.
Chief AUSA BAER, JR. further advised that Attorney
GERALD LEFCOURT attempted to get the subject's personal
appearance waived for the removal hearing because of an
alledged back injury (slipped disc) but that he refused and the
subject personally appeared at the removal hearing.
