HOFFMAN moved that the case be appealed and has
been allowed to remain free on personal bond pending the
appeal.
The "Berkeley Barb", an underground college news-
paper, published in Berkeley, California, in its December
27, 1968 - January 2, 1969 issue, on Page 11, carried an
article entitled "ABBIE Out to Get Due From Fuzz", which
stated in part as follows:
"ABBIE HOFFMAN is bringing a big, damage suit --,
with ACLU support -- against the D.C. pice who busted him,
October 4 for weezring a flag-shirt.
“Against his will they took a blood sample in jail
with a nondisposable needle --~ and this almost surely led to.
the hepatitis, which has caused permanent liver damage."
Tne records of the District of Columbia Court of
Appeals, Washington, D, C., as reviewed on February 19, 1969,
disclosed that the subject appealed his conviction in the
Criminal Division of the District of Columbia Court of Gen-
erai Sessions on November 20, 1968, for defiling the American
flag by wearing a shirt resembling the flag.
‘ne records further disclosed that the appeal was
filed on December 6, 1968, and was filed by the Clerk of the
Court of Appeals as Case Number 4865. .
