Asatatant Attorney General Caudle, tn a letter to the Bureau on January 7, 1947, stated that tt further appeared that the Marshall Gutomobtle was stopped three tines - once for the purpose of searching tt, @ second time to tnepect Marshall's operator's Itoense, and a third tine to nake the arrest; that after the arrest, Marshall's compantons were told that they night proceed to Nashville; that, tn supposedly preceeding to Columbia with Mmreshall, the offtcers turned off the metn ht gh- way tnto a dirt read leading elsewhere: and that they returned to the mata highway only after notteing that Marahkall’s con~ pantone were following then. In January, 1947, our MenpAts Offtce conducted an investigation tanto this matter ond learned thot Constable Butte had recetued tnformation from a colored informant that Marshall and Ate compantons were leaving Columbia, Tennessee, on the ntoht of Wovember 18, 1946, tn an autonodtle in which there would be a quantity of whteky. On the baste of thie tnforna- tion Sutte swore out a John Poe warrant decause he did not know who owned the automobile. Accompanied by a constable and two deputy shertffa, he atopped the automobtle drtven by Varahall between 7 and & pam. on the eventng cof November 18th, No whisky wae found tn the autonobtle., Deputy Sheri fife Lents and Gray orrested Merahall er detecting that he had bem drink~ ing on the baste of Marehall's driving an autonohbtle under the tnfluence of liquor. Marshall, according to the offteersa, wae taken directly to the office of Magistrate Poague, who erpressed the optnton that Merahall was not drinking, whereupon Marshall woe released. The offtcers contended that they stopped the auto- mobtle only once and that the enttre operation from the tine of etopptng the car untt! Marshall's release was within a thi rty-atnute pertod. (4415402) The Depertuent, on Jmrch 11, 1947, requested that addtttonal tnvesttgation be conducted tn thie case for the {or lowtng reasons, Durtng the tntervtew with Constadle Butte @ stated that tn the begtinntng he had cbtained the tnformation whteh caused hte te eecure the e¢garch warrant fron a colored tnformant, whose tdenttity he would not reveal.
