He mentioned that he has had several cenferences with MARSHALL and that he regards hip as personable, as an able lawyer and as well informed in the realm of civil rights statutes. He noted that MARSHALL is not outstanding and is not, in his opinion, qualified for the position of Unted States Circuit Court Judge. He explained that MARSHALL dees not have the capacity to diverce himself ‘from his personal convictions to the extent necessary to render a judicial opinion on the basis of facts proven in a legal manner. He added that he does not know anything about the background or character of MARSHALL but said he has never heard anything unfavorable against him in this respect. He stated that, as far as he knows, MARSHALL has, throughout his Jegal career, dealt only in civil rights cases and, consequentiy, does not have the legal imowledge which a pers sitting on the United States Circuit Court should have.
