reported the matter to the sheriff and three peace officers
were dispatched to the scene. The fight ensued and one of
the three Negroes wae killed.
4 local grand jury fatled tc tndict the three cffi-
cers who took part in the affray. Cn June 27, 1946, the De-
portment advised thet the matter would be presented to a
Federal Grand Jury and thet ne further tinvestization wes ce-
atred. On January 15, 1947, the faets were presented tn
Federcl Grand Jury in Gelveston and a no true bill was re-
turned.

One Frentice wfcCann, a Negro, dted from gunshot
wounds inflicted by Cit cr a? of the Mobile,
dlabome, Police Department on July 7, 45, at Maysville,
Alabanc. and another officer had stopped their
patrol car alongside a Negro dice game. The officers stated
that McCann wos shct while advancing tn a threctening manner,
disregarding orders to halt and after Of ft ce py had struck -
¥eConn with Ate ftet in an effort tc setcp him.
In connection with this incident, Marshall forwarded
to the Department of Justice a number of affidavits signed by
Negorce witnesses alleging that the e#hets were ftrec the tnstant
the patrol car stopped and without prevocaticn. Investigation
by the Bureau developec conflicting testimony on this potnt
and the Department advised that, in the absence cf sufficient
evidence to overcome the pelice officers’ defense of self-
defense, no prosecutive action was merited.
