The fight ensued and one of the three Negroes wae killed. 4 local grand jury fatled tc tndict the three cffi- cers who took part in the affray. Cn June 27, 1946, the De- portment advised thet the matter would be presented to a Federal Grand Jury and thet ne further tinvestization wes ce- atred. On January 15, 1947, the faets were presented tn Federcl Grand Jury in Gelveston and a no true bill was re- turned. In connection with this incident, Marshall forwarded to the Department of Justice a number of affidavits signed by Negorce witnesses alleging that the e#hets were ftrec the tnstant the patrol car stopped and without prevocaticn.
