The extent of his association with that applicant was unknown. In a meeting in 1948, sponsored by the National Lawyers Guild, Judge Marshall opposed Executive Order 9835, the loyalty order, as an infringe- meat on civil rights. In June, 1963, it was reported that Judge Marshall made the comment that if Ethel Rosenberg appeared in court at the present time abe would be granted a new trial, based on the fact that questioning of a defendam - concerning his pleading the Fifth Amendment is prejudicial to that defendant.
