Moacrabie Marvin Watson Teceiving 8 check from a Communist Party official for the purpose of “Jim Crow.” In 1945 he was listed as a sponsor for a meeting of the National Negro Congress, which organization has been 0 designated pursuaat to Executive Order 10450. tn 1046, Judge Marshall was arrested in Tennessee for driving while intoxicated. He was immediately released after it was determined that be was not intoxicated. In 1946 he was Listed as a reference by an applicant who was reported to be a member of the Communist Party. The extent of his association with that applicant was unknown. In a meeting in 1948, sponsored by the National Lawyers Guild, Judge Marshall opposed Executive Order 9835, the loyalty order, as an infringe- meat on civil rights. In June, 1963, it was reported that Judge Marshall made the comment that if Ethel Rosenberg appeared in court at the present time abe would be granted a new trial, based on the fact that questioning of a defendam - concerning his pleading the Fifth Amendment is prejudicial to that defendant. It has been reported that Judge Marahall played a leading part in the decision by the National Association for the Advancement of Colored People that Communist Party members and sympathizers had no place in that organization. . Civil fingerprim cards were located in the files of the FBI Identification Division.
