Bundy Asks New Trial |

Theodore R. Bundy says was sup-

Bundy, now 31, was convicted of
kidnaping Carol DaRonch, based large-
ly -on the victim's eyewitness tes-
timony. . ‘
Third District Court Judge Stewart
M. Hanson Jr., who heard the case
without a jury, sentenced Bundy to
serve one to 15 years in the Utah State
Hrison after the March 1, 1976, convic-
. tlon and a 90-day diagnostic evaluation.
Colorado Charge
Since then, Bundy has been charged
with first-degree murder in Pitkin
County, Colo., and is awaiting trial
. there Nov. 14.
Monday’s request for a new trial .
, contends that a report by Salt Lake
County Sheriff’s Det. Jerry Thompson
was not made a part of the case during
Bundy’s trial before Judge Hanson.
Det. Thompson interviewed Miss
DI Ronch, then 17, about her abduction
in} November, 1974. She was kidnaped
4 a man from Fashion Place Mall in
Murray. Her abductor handcuffed one

of her hands and: threatened to: shoilt
her before she was able to escapi,
police said. ,
Showed Photographs
The sheriff’s detective’s report told
how he showed Miss DaRonch several
photographs of different men.
“In going through the pictures, she
pulled out Mr. Bundy’s picture in her
hand, gave the pictures back to this
officer, stating, ‘I don’t see anyone in
there that resembles him.’ She was
asked what the one was doing in her?
hand. She stated, ‘Oh, here.’ I asked her:
if that was the guy or why she pulled it;
out,”’ Det. Thompson’s report says. - 4
The same report concludes: “This is
a-very poor witness in this detective’s
opinion, and I don’t know if ‘she can
identify the individual or if she is
scared or what the situation is.”
Deputy Salt Lake County Attorney
David E. Yocom, who prosecuted the
case, said later he will wait for a’ court
order before answering the legal docu-
ment prepared by defense attorney,
John D. O’Connell. |
The action awaits further action by a’
judge, who will decide whether it is all
valid claim.
