County Atty. David E. Yocom, Dr. Loftus admitted
‘ there are no studies of situations in which actual
victims of crimes were the subjects.
-. Nor have there been studies of persons who
picked the right picture, she said.
“Tf the choice were correct and a subject were
committed to that choice, there would be no reason to
change, would there?’”’ Yocom asked.
“That’s right,” said Dr. Loftus.
Edward M. Barton, a veteran police officer, now
retired and working as an investigator for the Legal
Defenders Association of Salt Lake City, said he
thought it would have been better if Miss DaRonch
had not been shown more than one photo of the
suspect. 5
The victim was shown a photo of Bundy taken in
August 1975, and later showed a photo taken for his
driver’s license shortly after the alleged incident.
Barton said he would not himself have shown her
both photos, even though they. were substantially
different... . .
The former police officer also said he had .
participated in-as many as 200 line-ups and that
-vietims frequently pick the wrong person. He said
that in his opinion, line-ups are not the best form of
evidence. .
Yocom asked if, when victims do pick a man ina
. line-up and it is the correct suspect, identification is
made very quickly. Barton responded that this is
usually the case. .
Miss DaRonch picked Bundy from a police
line-up almost immediately, it was - established
during the prosecution’s presentation.
Regarding Miss DaRonch’s testimony that the
Volkswagen in which she was taken from the
‘shopping center had a tear in the rear seat, a
” mechanic testified that many such vehicles have torn
seats.
The sun causes the seats to tear, according to.Bill
Gord, an employe of Jack’s Top Shop.
__ Former neighbors-of Bundy, James Dunn and his
wife, Janet Davis, told Hanson they had never seen.
Bundy wearing dark patent leather shoes, nor had
, they seen handcuffs or a crowbar in Bundy’s car.
Miss DaRonch earlier had testified’ that her
‘abductor wore dark, shiny shoes and that he
threatened her with a crowbar. Her assailant also
_ attempted to put handcuffs on her, and succeeded in
getting one of the handcuffs secured before she broke
_free from him, she testified.
A former girlfriend of Bundy, Ann Swénson, said
she had been in his ear and apartment on many
- occasions and did not see any patent leather shoes.
Nor did she recall a rip in the seat of the car.
Policemen found a pair of dark, shiny shoes in
Bundy's apartment after it was searched in late 1975.
Hanson. who is hearing the case alone after
Bundy waived right to a jury trial, took under
advisement a defense motion to have the charge
reduced to simple kidngping_,
