Bundy is accused of abducting Miss DaRonch from the Fashion Place Mall: parking lot the night of Nov. 8, 1974, and threateni it wor 8 1974 ening her with a gun and During Tuesday afternoon i y Tu proceedings, th defense failed in an attempt to block testimony by Sgt. Bob Hayward of the Utah Highway Patrol who arrested Bundy on Aug. 16, 1975, and searched his . aoe woe he . 1 - He said he arrested Bundy after ‘he saw him driving in an area near 3378 Hogan St. in the county. He said Bundy showed him his license and said he was lost. Hayward testified he looked in the car and saw a small crowbar in the back seat. He said he then asked “Ts it all right if I look in your car?” and Bundy said “It’s allright.” , , Hayward said two other patrol cars arrived and the other deputies took the crowbar out of the car and also a pair of handcuffs they found in the trunk. Defense Atty. John D, O’Connell objected to this testimony, Claiming the prosecution was trying to besmirch his client. ‘“‘Just because a man has certain. things in his car doesn’t mean he’s going around kidnaping girls,” he said. . The judge ruled the testimony could stand. Another witness, Margarith Maughan, who lived in the same avenues apartment house as Bundy, said- she knew him well. ‘ oot . She testified that she had seen a tear in the back seat of Bundy’s car in the fall of 1974 and that stuffing was coming out of the seat. Miss.DaRonch had testified Monday, the opening day of the trial, that the back seat of her abductor’s © car was ripped and that it had rust spots and dents on the outside. . O’Connell asked Miss Maughan if she had ever seen Bundy wear dark patent leather shoes and she said she had not. Miss DaRonch had testifled that her assailant wore such shoes and police found a pair of black patent leather shoes in Bundy’s apartment during a search. . .. ‘Salt Lake County Deputy Sheriff Jerry Thompson testified about showing several pictures to Miss - DaRonch, including one of Bundy, to see if she could identify her abductor. He said she took one picture out of the stack and gave the others back and when he asked her why, she said “‘T don’t know.”’ He said he asked her again and she said, “It looks something ’ like him, I really don’t know.” : ‘Connell seized on this, chiding Thompson for having asked her more than once about the picture. He also said it was the second photo of Bundy the girl had been shown and asked, ‘““Wasn’t it improper. to show a witness another picture of the same man? , “J didn’t think it was wrong when the second picture was so different from the first,”” Thompson said. The first picture Miss DaRonch was shown was one taken after Bundy’s arrest. The second was a driver license photo. Thompson testified that he took Miss DaRonch to look at Bundy’s car after it had been fixed up at.a repair shop, with the back seat repaired and the rust and dents removed. He said Miss DaRonch recog- nized the car.
