In Marbury v. Madison the Court commented: "By the
Constitution. , .the President is invested with certain political
powers, in the exercise of which he is to use his own discretion, and
is accountable only to his country in his political character, and to his _
own conscience." In 1863, the Supreme Court in the Prize Cases
went on to uphold the President's authority to blockade insurrectionary
Southern ports without Congressional authorization, In 1915, the Supreme
Court in Mackenzic Vv. Hare explained that the Federal judiciary should
be slow to curtail such powers, 5
In United States v. Curtiss-Wright Export Corp., decided by the
Supreme Court in 1936, the Court again commented upon the President's
powers in the area of foreign affairs,. It explained that there is a oO
significant difference between the conduct of domestic, as opposedto
foreign affairs, and stated that the Government's powers in the area of
internal affairs are limited fo those specifically enumerated in the
