‘Item 22 asks for 1 a List of all surveys made since 1970
which did not result in the Bureau's requesting pernission of -
the Attorney Ganeral to install br activate a microphone
or other electronic listening device. .-
There is no central index or document “Mating
feasibility surveys conducted involving physicaf entry — -
or trespass which did not result in the Bureau's. requesting
permission of the Attorney General to install or activate
a warrantless microphone or other warrantiess electronic
device. This statistic can be developed only by review
ef individual casesx in those matters mat likely to have
been targets of electronic surveillance. This would entail
review of literally hundreds of case files at FBI
Headquarters. In many cases, this Yeadquarter's file
review would not indicate Whether entry | or trespass vas
effected in the conduct of a survey. It would be
necessary in a number of cases; therefore, to review.
field office files {and in some cases to interview
personnel) to learn which cases fit into the above category.
With respect to Title III surveillances, no —
pre-court order surveys have been conducted in relation
to microphone installations. Where microphones have been
installed, the initial entries were not conducted util
issuance of a court order. If the microphone installation
was subsequently determined to be not feasible, the
installation was not made. . :
