Memorandum D. Ryan to Mr. Decker Re: Allegations of Unauthorized Leaks of Classified Information Executive Order 11652 - ADDENDUM, LEGAL COUNSEL DIVISION, 6-7-77 The following is being set forth in response to Mr. Revell's routing slip of 6-6-77 in which he requested Legal Counsel Division's views on this matter. The interviews and affidavits for which permission is sought concern a matter which could be the subject of criminal charges under Title 18, United States Code, Section 793(d}, (copy attached). Since the individuals who are to be interviewed and whose affidavits are to be secured are identified as having had access to information which was wrongfully disclosed, this necessarily means that they are, in effect, suspects in any potential criminal prosecution. Therefore, it is our recommendation that such individuals be advised of their rights before any interview and the securing of aifidavits. APPROVED! Ay. Adu Sem Livtt te Spe Yop.
