Supreme Court — Part 28
Page 37

The criminal-contempt convictions were
upheld last week by the Supreme Court
but only by a 4-ta-4 vate.
The majority opinion, written by Jus-
tice John Marshall Harlin, cited the over-
whelming precedent uphelding criminal.
contempl convictions without juries. Jus-
tice William J. Brennan reserved his opin-
ion on the constitutional poits involved,
dissented on the ground of insu'tuient evi-
dence. But Huge Black wrote a desenting
opinion for himself. Chiet Justice bark
Warren and William Douglas. which
struck at the foundations of the padicr-
ary’s enforcement powers. Wrote hick:
“The power of a judge to inflict punish-
ment for criminal conterypt by means of
a summary proceeding stands as an anem-
aly in the law . 0. No offal. regardless
of his position or the purity and nubleness
of his character. should be granted such
autocratic omnipotence.”
“Sinew of the Law." What Hugo Blick

and dissenting brethren did not concede
was that by attempting te wipe out hy
judicial decree the principle and) practice
al centuries, they were arrogating to them-
selves ao Very reak sort of omnipotence,
That fact was pointed out in an) opinion,
concurring with the miajertty, by Felix
Fronkfurter: “To be sure. th is hever boo
laie for this court ta correc! a misconcep-
tion, Ip _ap_ucGtetopal decision, ( But] to
sav that everybody on the court has been
wrong for 150 vears and that that which
has been deemed part of the bone and
sinew of the law should now he extirpated
ir quite another thing. Dectsion-making is
not a mechanical process, but neither is
this court an originating lawmaker.”
Closing the Book
The Supreme Court abe closed the
book on one of the last of the Truman
Administration scandals last week. it) re-
fused to review the convictions of Mat-
thew J. Connelly, appomiments secretary
to President Truman. and Theron Lamar
(“Sweet Thing’) Caudle, Assistant At-
torney General in charge of the Justice
Department's tax division. They were
fined $:.500 and sentenced to two years
in prison each for conspiring to fix a tax
case during their days in power. Although
Connelly and Caudle can ask the Supreme
Court to reconsider, their chances are
indeed remote.
