Admirer of President
The new appointee added that he haa been
an admirer of President Eisenhower since he
first nfet the President at the time he was
appointed to Sixth Circuit Court bench in 1954.
Mr, Stewart also spoke highly of the conserva-
tive Justice Burton. ‘Needless to say,” ‘he
-declared, “I admire him greatly for his dili-

gence, fair-mindedness and high mindedness. =
Mr. Stewart is the fifth member named to
‘the High Court by the President. His appoint- |.
ment marks the first time Eisenhower ap-
pointees have made up a majority-of the nine-
man court. The President appointed Chief Jus-
tice Warren in 1953, Justice Harlan in 19565,
Justice Brennan in 1958, and Justice Whit-
taker last year.

The American Bar Assoctation heartily en-
dorsed Mr. Stewart’s selection. Bernard G.-
Segal of Philadelphia, chairman of the A.B.A.’s
standing committee on the Federai judiciary,
called the appointment an “excellent one.'' He
said hia committee reported to Attorney Gen-
eral Rogers that ‘‘Judge Stewart is fully quali-
fied for elevation to the Supreme Court of
the United States.”
Mr. Eisenhower named Mr. Stewart to the
Sixth Circuit Court of Appeals in April, 1954.
The Sixth Circuit imfludes Michigan, Ohio, Ken-
Vay and Tennessee.
It was belleved Mr. Stewart’s Midwest
t sackgrouna was a relevant factor in hia se-
{.lection. Retiring Justice Burton waa a former
‘Senator from Ohio. Justice Whittaker, from
Missouri, is the only other Justice from the
‘Midwestern area. ; .

Mr, Stewart had no previous experience as 4,
Federal district judge, but was a member of:

Sawyer and Dinsmore.
Born in Jackson, Mich.,-Mr, Stewart nas

City Council in 1950-53 and served as vice
mayor of the city during the latter two years.
