tions, state rules governing adrnis-
sions to the bar and security

that this bill would threaten the
balanced system of government,
based on our traditional separation
of powers. And, since it would per-
mit lesser Federal courts to pass on
these questions, it would lead to
the utmost confusion.
MOREOVER, as he said, this is a
retaliatory measure, arising from
the personal dissatisfaction of Sep.
nner and others with some recealt
preme Court decisions. Legisli-
tipn passed in an atmosphere of r¢
venge seldom is sound.
We, too, have disputed somé of
these decisions. But we must as-
sume the court expressed its hon-
-est judgment. And in some cases
the trouble lay in Congress’ own
acts, not in the. court’s interpreta-
tions, :
In any case, the Senate is di-
rected by the Constitution to “ad-
vise” as well as consent to appoint.

INSTEAD of passing a punitive

preme Court justices, the Senate
would do well to encourage the

men available, preferably by pro-
motions for the cireuit or district
courts.
The Jenner billis a form of court-
packing in reverse, and the Senate,
in that notable battle of 4237, a
