a re eeelanationera nENy , ner ar co Se — 5 en ee «These Charming People. | HINGTON is a box full of rumors anyway. Now that there's a seat left vacant in the pases se Court, ¢ everybod is en- free guess eee who will be 4 Justice ‘Byrnes’ —sutc- cessor. The ttrouble is _ that in Wash- ington every whisper : given the . coat of gu- thenticity and = author- ity, Column- ists and com- ; m entators have gone to Eser Cansial town on this Supreme Court matter. Everybody in the Gov- ernment, and outside of it, prac- tically, has been mentioned as & possibility for it, Most frequent- ly mentioned have been Attor- ney General Francis Biddle, who would seem the logica] succes- sor: Senator Alben Barkley, mna- } dority leader, and as a dark, | but spectacularly - sensational | horse, Judge “Rosie” Rosenman, adviser to the President and co- author of many of his best speeches. Every columnist in the busi- ness, practically. has tried to guess who will succeed Byrnes. Undoubtedly they'have all re ceived “inside” tips from the “highest and — best-informed” sources. Now here's my _ tip, and, confidentially, methinks it’s the right one—but who can swear to it? I yy at sounds surprising and unorthodox, but don’t for- get that the breaking of tradi tions has become a favorite New Deal method. Besides, there's a ead of his boss, the Attorney his Supreme Court judgeship miy temporarily. Justice Byrnes, who resigned to become Eco- momic Czar, consented to take the new job for the “duration,” but he was assured that when the war will be over he will get Nobody doubts that Byrnes is a fine and unselfish an. Nevertheless, it's a very extraordinary case for a man to leave the Supreme Court for any other office in the tarid—unless. perhaps, it be the Presidency. A judgeship in the Suprema Court is a job for life, and ‘t’s the greatest distinction that any American can obtaia. Even in the practical sense, Byrnes lefv s £20,000 a year ‘jah for one that pays him on'y $12.000. Solicitor General Fahy was approached on this proposition and he is said to have accepted it, When time comes for him to “resign” he hes also been as- sured that another good job would be in hand for him. ~ But héte are_some more inside fac e Supreme Court. T ween Justice Felix Pranglurier on one side, and a usiice Frank Murphy and Jus- tice, Wi other side, has far from di down. ese last few weeks there have been a Jot of stories hat both Murphy and Douglas were Testiess and Intended to step down from the Supreme Bench. Frank Murphy, it has been said, wants only to wangle- a definite promise that he'll be os Page yt AHY, tn fact, will be given E ~was made ‘economic planted by the opposite faction. Anyway, they insist that neither a nena ~ ve “By IGOR CABBINI asana | assigned in active duty with troops with his present rank of Heutenant eoloneL. And William Douglas, whe, it has been re -ported, ‘cried his eyes out when ezar (because he was hoping to get ft), is stil] angling for any good Administration job. One scribe went even as far as to say that Justice Douglas was delib- eraling the possibility of enlist. ing in the Army as a buck pri- vate! Justices Murphy and Douglas won't say so, but their friends are loud with accusations that all these wild rumors were | Murphy nor Douglas have the slightest intention of quitting the Bupreme Court. And that, undoubtedly, is the truth UT to continue judicial : stories: Ogden Hammond jr,, the diplomat who is shortly ‘bringing his case against the State Department before the highest court in the land, gave a cocktail party the other after. noon for Hollywood's boy genius, Orson Welles, and Delores Del] Rio. La belle Del Rio, however, wasn't there. Orson Welles said he was 60 sorry, but she was in bed with the sniffles. ‘ Other- wise, former Attorney General Homer Cummings and Assistant Attorney General Thurman Arnold were there, and had a lot of things to say to and hear ~ from Mr. Welles. Also at the party were Mrs. Justin Miller and her attractive daughter. That was amusing, because Mrs. Miller's husband, © Justice Miller, wrote the opinion against Hammond in the Court of Appeals, and ‘that’s why “Og- gie” is bringing it before the Supreme Court. But judicial battles cannot interfere personal friendships. O least, don’t in this case. Tolson “ E. A. Clegg .
