Petitioner made a strong showing of good poral eharacter, except that it ‘appeared that from 1938 te 1987 he had used certain aliases, .. that he had been arrested (but sever tried or convicted) on several occasions prior to 1940, and that from 1932 to 1940 he was a member of the Communist Party. The State Supreme Court sustained the Board. The vu. S. Supreme Court held: On the record in this case, the State of Rew Mexico deprived | petitioner of due the practice of law. Reversed and remanded. Konigsberg v. State Bar of California (1957) 353 U.S. 252. In 1954 the Committee of Bar Examiners of California refused te certify petitioner to practice law in that State, though he had satis- factorily passed the bar examination, on the grounds that he had failed to prove (1) that he was of good ural character, and (2) that he did sot advocate forcible overthrow of the Goverment. He sought review by the State Supreme Court, contending that the Comittec's action deprived hin of rights secured by the 14th Amendment. The State Supreme Court denied his petition without opiaton. The D. S. Supreme Court held: The evidence in the record does not rationally support the only two grounds upon which the Committee relied in rejecting petitioner's application, and the refore the State's refusal to adnit bim to the bar was a denial of due process and equal protection of the laws, in violation of the 14th Amendment.
