It was reported in the Chicago Yefender® on Jume 9, 1945, that on
that date the Suprape Court upheld the rigit of the states to make deliberate
token placement of negroes on jury panels and remain within the lew, In a
six to three decision the highest court refused to set aside the murder con~
viction of L. G>{/AITKENS, Dallas negro, on a plea that only one negro was per-
mitted te serv@ oh the grand jury which indicted him. ATKENS contended that
this would deprive hin of his constitutional rights.
CKENZIE wrote an article in the Pittsburgh "Courler" on
June 9, 1945, in h, in referring to the MAYES case she stated in part as
follows: co,
"A disgraceful chapter was added to the bad record which the
Supreme Court has been plling up for itself of late by its refusal
last week to review the District of Columbia Court of Appeals
decision upholding a racial covenant. For almost thirty yoars negro
lawyers have been fighting the injustice of the restricted covenant,
and as far as the historical and social development of the problem
ie concerned never was orderly democratic progress as ready for favor-
able and final judicial determination as now,"
' McKENZIE pointed out that the Supreme Cow't did not risk in the MAYES
case awitten opinion but that the District court of Appeals had dared to dis-
cugs the social aspects of housing restrictions based on race. This opinion
was rendered by Chief Justice GRONER of the Appeals Court, and McKENZIE concluied
as follows in commenting on GRONER'S decisions;
"The highly tentative feeling the Chief Justice has concerning
the ultimate ability of the races to live together in peace is a
dangerous Fascist explanation for one with so great an obligation
to the Constitution of the United States. I+ demonstrates how astern
a battle still lies ahead for negro leadership.*
