ORDER OF DISMISSAL
This cause comes before the Court upon the defendant's
motion to dismiss. A review of the pleadings filed in the case
reveals that the defendant was not properly served as required
under Rule 4 Fed.R.Civ.P. Furthermore, the federal courts are
courts of limited jurisdiction and the basis of that jurisdiction
must be affirmatively plead in the complaint. See 28 U.S.C. §1330
et seq. As the instant complaint suffers from these two defects,
it is DISMISSED without. prejudice.
