3. In co-nection with the investigation entitled,
"tnknown Subjects; Alleged Irregularities, General Election, State
0° Marylanc, November 7, 1950; Election Laws; Ferjury,"” it was
ascertained that Senator McCarthy was involved in the tasuance
or certain campaign literature for Senator Putler.
During this tnvestigation it was determing that a
tabloid entitled, "From the Record,’ was released during the
Putler campaign on behalf of Putler, which tabloid made it
appear that Senator Tydings hod presided over a Senate
investioaticn tn suck a manner as to "whitewash" charges
concerning disloyalty of State Department employees. The idea
for the tabloid was conceived by Butler's supporters, including
Tenatcr MeCarthy ani employees of his office. The tabloid
stated it was sponsored by "Young Democrats for Butler," which
orgaxizaticn paid for the publication and distribution and was
dater retmhursed therefor by the Butler campaign treasurer.
Senator McCarthy ani his staff employees might be technically
considered as possible defendants under Section 612, Titie 14,
Inited States Code, which provides penalties for failure to
jabel :ublished cazypaign literature which does net contain the
names o*° the persons, committee, corporation , etCe, or the
officers thereof responsible for such publication and distribution.
It shouid be noted that copies of reports in this case have been
) furnished to the Depertment and tt should be furtier noted
