The Attorney General stated he thought in the light o
the President's letter, tt would be necessary that he talk to th
President and mate some definite recommendation, otherwise he wa
fearful that the President would be advised by hts advisors in
Florida to make the files ali auaiiable. In view of that, the
Attorney General indicated that he would be inclined to adopt the
second, namely, to read the memorancum to the Committee in |
Erecutive Session.

You advised the Attorney General that your position was
still the same, that you felt the files should not, under any |
circumstances be made available, that you would defer to his
judgment with reference to Item #2; that, however, if this was
done, a definite position should be taken that the files wouid
not be made available at this time and in no circumstances would
that position be altered once the memorandum had been read to the
Connittee.
You suggested the desirability of a statement being
issued by the Department advising of the position adopted by the :
Department and including a statement that the files would not be
made avatlable.
The Attorney General indicated that he thought this was
a good idea and suggested the destrability of a jotnt statement. :
During the time that you were in the Attorney General's
office, the Attorney General received a call from Senator Tydings
who informed the Attorney General that he felt that the adminis+-
tration was losing ground tn this argument with McCarthy and that
a decision should be made by the Department one way or the other
immediately; that if the decision was that the files would not be
made available, it-would be necessary for the comnittee to request
the appearance of the Attorney General and yourself either by
subpoena or by letter to appear before the Committee and explain
to them why the files could not be made available.
The meeting concluded with the Attorney General indi-:
eating that he was going to propose to the President the reading
of the memorandum, as set forth in Item #2 above. |
